Probable Cause Hearing For New London Murder Suspect Taking Place This Week

Davion Smith accused of November murder of Jorge Rosa

A New London man accused of involvement in a Montauk Ave. home invasion and murder in November will go before a judge in a probable cause hearing on Thursday.

The hearing will take place in before Judge Susan B. Handy to determine if investigators had sufficient evidence to charge 19-year-old Davion Smith in the Nov. 12 slaying of 26-year-old Jorge Rosa. Smith is charged with murder, home invasion, and first-degree burglary.

The murder occurred at about 4:17 a.m. at Rosa's Montauk Ave. apartment. According to a court affidavit, a witness said entered the apartment with handguns. The woman said Holmes fired two or three shots at Rosa before he and Smith fled. Rosa died at of gunshot wounds to the chest, torso, and genitals.

The woman said Smith visited her on Nov. 3, a day before Holmes was to be released from prison, and told Rosa, the woman, and some of her friends that Holmes was being freed. She said she had been dating Holmes for about four years and broke up with him shortly after he went to prison. She also identified Holmes and Smith from a photo lineup.

Holmes, who faces the same charges as Smith, was arrested later in the day at the Day's Inn in Old Saybrook. Smith remained at large until March 20, when the received a tip that he was at the Winthrop Square Apartments at 187 Huntington Street. Smith was as he tried to leave the apartment through a rear window.
